Conflicting Judgments: CJN Summons Rivers, Kebbi Chief Judges, Four Others

By Chris Udochukwu Abuja (Precise Post) – The Chief Justice of Nigeria and Chairman of the National Judicial Commission, Justice Tanko Muhammad, has summoned the chief judges of six states over the conflicting decisions all given by courts of coordinate jurisdiction. The chief judges summoned are those of Rivers, Kebbi, Cross River, Anambra, Jigawa, and Imo states. “It has become expedient for me to invite you for a detailed briefing on the development. “This is even more compelling, having regard to earlier NJC warning to judicial officers on the need to be circumspect in granting ex parte applications,” the summon sent to the chief judges read in part. Media aide to the CJN, Ahuraka Idaho, also confirmed the development to our correspondent on Monday. He however said he had no information on the date the summoned judges will meet with the CJN. Recall that last week alone two ex-parte orders were given by Rivers and Kebbi courts. Party Deregistration: INEC To Approach Supreme Court Over Conflicting Judgments

By Chris Udochukwu Abuja (Precise Post) – The Independent National Electoral Commission (INEC), said it will approach the Supreme Court over conflicting Appeal Court judgements. The commission in a statement on Monday, said it is in receipt of the judgment of the Court of Appeal delivered today, 10/06/2020 in an appeal filed by ACD and 22 others relating to their deregistration by the commission. In the judgement, the Court of Appeal held that the registration of ACD and 22 others is ultra vires to the powers of the commission and ordered the commission to reinstate them. Precise Post recalls that in July 29, 2020 the Court of Appeal sitting in Abuja in an appeal filed by the National Unity Party, (NUP) affirmed the power of the commission (INEC) to deregister political parties that fail to meet the constitutional threshold in section 225A. Dissatisfied with the judgement, the National Unity Party lodged an appeal which is presently pending before the supreme court.
