The Managing Director of Ngrshine Industries Ltd, Ugochikwu Madumere has described the alleged plan by Chen Xiao Ming and his company (Gaoxi Ong) to break into the warehouse where goods ceased by the court are stored as an afront to rule of law.
Madumere said reliable report has it that Ming is planning to get protection of the security officers to carry out the illegal act despite that an appeal was entered and the record was transmitted at the court of appeal on the in July 2022.
He cautioned that any attempt to apply self help on a matter before the court having regards to the proceeding of the apeallate court will attract contempt Charges. Recall that the court has recently showed that any contempt of the court would no longer be treated with kids gloves . This is evident in the recent court contempt pronounced against the EFCC Chairman and that of IGP.
According to him, there is distress hint that the defendant Mr Chen in collaboration with the law enforcement Agency is interested in tampering with the subject matter of appeal despite being aware of the date for hearing which is March 9, 2023.
He said that the police is aware of the fact that the defendant is accused of forgery, having purportedly forged a document of Trade-mark belonging to me and was formally charged in Lagos state Magistrate court for same Offence.
Adding that the same Mr Chen against whom there is warrant of arrest is freely going in out of Police station without his being apprehended.
The Crux of the matter:
Madumere said that in a suit filed by Mr Chen challanging my Trade Rights at the Federal High Court sitting in Lagos, the presiding Judge, Justice Buba gave a ruling authenticating my certificate and in their counter submission, they requested that the court should investigate and know who own the original right. The court caused an investigation and affirmed that the certificate of Nigrshine Industries Ltd is authentic by the findings of the trade mark. Since the court pronouncement Mr Chen who brought the matter to court abandoned it. Based on that I didn’t go ahead withy counter claim and I continued with my business.
Suddenly he resurfaced again, but now wrote a petition to the police and police went to the Federal High Court in Abuja and asked that anything marketable about the product should be stopped pending the findings of their own investigation and court granted the application gave an exparte order that Police should investigate and report back in 90 days.
Also, court gave an order that the bailiff should go ahead and evacuate all the things in the warehouse Pending the determination of the case. As the court bailiffs started carrying the goods on the first day, the second day, Mr Chen allegedly hired thugs (hoodlums) weilding matchets and broken bottles, beat up the court bailiffs and chased them away to stop the execution of the order of court.
